Instant Sailing Terms and conditions

Terms and Conditions of Instant Sailing d.o.o. apply to all our services that are directly or indirectly made online, through mobile device, by e-mail or telephone. By accessing, browsing and using our website and/or by completing a reservation, the Client acknowledges and agrees to have read and understood, also agreed to our Terms and Conditions (including the Privacy policy). These terms and conditions are subject to legal liability and are binding for the Client who charters the vessels. Before making payment the Client confirms to agree with our Terms and Conditions and is entering a direct, legally binding relationship with Instant Sailing.

In case of dispute, the parties will try to resolve it in a peaceful manner. In case the agreement cannot befound and the parties are not able to reach the mutual satisfaction, the court in Split, Croatia has the jurisdiction over their dispute.

I. Payment methods

Primary method of payment is bank transfer. The Client accepts to bear the full cost of the money transfer. It is also possible to make the payment directly online using one of the following cards: MasterCard®, Maestro®, Visa.

Payment and credit card authorization takes place via the T-Com Pay Way system. T-Com Pay Way applies the most modern standards of data protection – Secure Socket Layer (SSL) protocol with 128-bit encryption and MD5 algorithm. ISO 8583 protocol ensures that data exchange between T-Com System and the authorization centers of credit card companies is done in a private network that is protected from unauthorized access by double-layer of „firewall”.

II. Currency conversion statement

All payments will be effected in Croatian currency. The amount your credit card account will be charged for is obtained through the conversion of the price in Euro into Croatian Kuna according to the current exchange rate of the Croatian National Bank. When charging your credit card, the same amount is converted into your local currency according to the exchange rate of credit card associations. As a result of this conversion there is a possibility of a slight difference from the original price stated on our web site.

III. Privacy statement

In order to use the Instant Sailing d.o.o. services, you need to (a) be 18 years or older, or be 13 yeas or older and have your parent or guardian’s consent to these Terms, and (b) have the power to enter a binding contract with us and are not barred from doing so under any applicable laws. You also warrant that any submitted registration information to Instant Sailing d.o.o. is true, accurate and complete, and you agree to keep it that way at all times.

Instant Sailing d.o.o obliges to offer protection of personal information of its users, in a way to gather only the most basic information that is necessary for fulfilling our obligations towards the User. All of the information about users are strictly guarded Instant Sailing d.o.o. Ninska 30, 23210 Split, Croatia and are available only to the employees that need those information for business purposes and those information will not be in any way ceded to third parties without their consent – except for the information which are necessary to business partners (Charter operators) for executing their duties. Also, each and every employee of Instant Sailing d.o.o. and business partners are equally responsible for respecting the protection of personal information.

All Users are obligated to provide accurate, valid and complete personal data while filling out the forms, and in contrary, Instant Sailing d.o.o. has the right to cede the access of their services to that kind of User. A User who is using our website and is making a booking and paying for a certain vessel through Instant Sailing agency cannot be a minor and is taking full responsibility in cases when false documents or information are presented to Instant Sailing team.

While filling outtheir e-mail address user is given a choice to remove its e-mail address off the list which serves for informing users of special offers and discounts and for improving our services.

IV. General business conditions
  1. Business method

    Instant Sailing d.o.o. is an online charter agency which offers a broad variety of vessels to charter on short-term periods through our real-time search engine. The vessels, published on our official website (and all of its subdomains) are vessels listed in the fleets of various charter fleet operators (hereinafter: Charter Operators). When booking these vessels Instant Sailing operates as Agency-Mediator.

  2. Booking process

    Once the User chooses a desired vessel on our website, the next step is to fill out the booking form and choose the payment method. After booking process is finished, the User will receive all necessary documents via e-mail from Instant Sailing's team. The Payment takes place in two equal rates as stated in the payment plan. The first instalment of the total payment amount is due within 3 days after the confirmed booking. The second payment is due no later than 45 days prior to embarkation. The vessel can only be taken over after the full payment has been settled.

    The Client acknowledges that the charter operator’s Terms and Conditions may be different to ours. Upon booking of the vessel, Instant Sailing as a Mediator will provide the relevant Terms and Conditions of the charter operator to the Client. The Client acknowledges that for his obligations to the charter operator the Terms and Conditions of the charter operator will apply.

  3. Expenses

    The price of the charter displayed on our website includes the vessel equipped according to the inventory list presented by the charter operator. The charter price also includes VAT valid at the time of reservation. In case the VAT rate increases prior to the beginning of the charter, the Agency reserves the right to charge the VAT difference amount. The charter price usually does not include extras such as security deposit, insurance of deposit (Damage Waiver), food and beverages, fuel, costs of marina services and moorings, harbor fees, taxes or any additional services other than those explicitly stated in the inventory list.

  4. Cancellation policy

    In case of cancellation the Client is liable to inform the Agency by e-mail without any delay. Should the cancellation occur 5 days after the reservation is made Instant Sailing reserves the right to charge a 10% handling fee of the total booking amount. Cancellations within 4 days after the reservation are free of charge. If the Client makes a cancellation 45 days prior to the embarkation the Agency will keep 50% of the total booking amount. If the cancellation occurs within 45 days prior to the embarkation the Agency is entitled to keep 100% of the charter fee. In case the Client does not come for the check in (‘non-show up case’) or in case the Client leaves the vessel before the contracted check out time (‘early abandon case’), the Agency will also apply a 100% cancellation fee and Client does not have the right for a refund.

  5. Changing terms

    Should the Client request a smaller change in the booking details (e.g. change of name on the invoice or booking confirmation, etc.) the Agency keeps the right to charge an administrative fee of 50 EUR per case. Should the Client request Instant Sailing d.o.o. Ninska 30, 23210 Split, Croatia a change of period, change of vessel or the base, or any other major change, the Agency reserves the right to charge for the cancellation of the first booking. In case the Agency manages to grant the requested change without charging the cancellation fee of the first booking, in such case an administrative fee of 250 EUR shall be charged to the client.

  6. Licence

    Some Vessels published on our website can be chartered bareboat and others only crewed or skippered. In case the Client requires a skipper it is necessary to point out this information upon booking. In case the Client does not require a skipper and is chartering a bareboat vessel, it is important that the Client provides a copy of his/hers valid skipper license in order to approve the document with the charter operator. In case the license is not accepted by the charter operator the Client will be obligated to hire a professional skipper. For some vessels a professional skipper and/or other crew members are obligatory regardless of the Client’s licenses, this will be indicated upon reservation.

  7. Other conditions

    Should the Charter Operator cancel the booking due to severe damages on the reserved vessel or in case other unforeseen situations occur to the vessel the Client will be reimbursed by the charter operator according to their Terms and Conditions. These situations are usually severe damages caused by previous clients on the vessel or force majeure. The Client should be aware of the fact that neither Instant Sailing nor the charter operator are responsible for the occurred situation and thus the Client shall aim to be cooperative towards finding an appropriate solution under the given circumstances.

V. Change of conditions

Instant Sailing d.o.o. reserves the right, at any time and without prior notice, to either remove or modify aforementioned Terms and Conditions. Therefore, we recommend our customers to keep an eye out for information regarding potential changes to our Terms and Conditions. Please note that in case our Terms and Conditions have changed and the Client keeps using services of Instant Sailing d.o.o., it is implied that the new Terms and Conditions have been read, understood and accepted completely.
